SB 343 Truth in Labeling Law – Action may be required | as of August 2025
WHAT IS SB 343:
SB 343 is a California bill regulating and/or prohibiting the use of any symbol or reference to the recyclability of packaging materials including flexible films.
IMPORTANT: The #4 LDPE chasing arrows symbol on the eye spot is specifically noted in the bill and must be revised before October 4, 2026.
IS LDPE CLASSIFIED AS A RECYCLABLE MATERIAL? – YES
Yes. LDPE can be recycled given the appropriate means to collect and facility to process the material.
DOES CALIFORNIA RECOGNIZE LDPE AS RECYCLEABLE – NO
While the film itself can be recycled, it must meet ALL three requirements per SB 343 to be considered “Recyclable” in California.
- Meets qualifications set forth by the Association of Plastic Recycling Design Guide to be considered an “APR Recognized Solution”.
- YES. Most plain (unprinted) LDPE is an APR Recognized Solution*.
- Be accepted for collection by jurisdiction recycling programs collectively serving at least 60% of the California population.
- NO. At this time LDPE recycling collection is significantly below 60%
- Be sorted into defined streams by large volume transfer/processing facilities; collectively serve at least 60% of statewide recycling programs and send them to a reclaimer and reclaim them consistent with Basel Convention.
- NO. At this time LDPE recycling collection is significantly below 60%
DO I NEED TO TAKE ACTION? – MAYBE
Check to make sure all LDPE #4 symbols in all of your artwork for products sold in CA do not have chasing arrows.
- If the #4 LDPE symbols (including those in eyespots) do contain arrows, you must update the LDPE #4 symbol on your artwork to the new logo with no arrows.
- Any statements in your artwork indicating recyclability must be removed.
- Any statements directing consumers to recycle products or packaging unless certain criteria are met must be removed.
Deadlines:
- Submit plate/artwork changes to Great American Packaging prior to September 4, 2026
- Effective for products manufactured after October 4, 2026
